These terms govern your use of FieldHail, the website at fieldhail.com and the FieldHail apps (together, the "Service"). By creating an account or using the Service you agree to them. If you are using the Service for a farm business, you confirm you are entitled to bind that business.
FieldHail reads public weather data — NOAA MRMS radar products, National Weather Service forecasts and warnings, Iowa Environmental Mesonet rainfall analyses and USDA field boundaries — for the field locations you provide, and shows you the results and sends you notifications about them.
Hail size in the Service is a radar estimate (NOAA's Maximum Estimated Size of Hail). Radar does not see hail fall; it infers it. One radar cell covers roughly 220 acres, so the Service can indicate which part of a storm's path a field was in but cannot say what fell on any particular part of a field. Rainfall totals are radar-blended analyses, lightning is a probability, and forecasts are forecasts. All of it can be wrong. The Service is a tool for deciding where to look first; it is not proof of loss, not an agronomic recommendation, and not a substitute for inspecting a field.
Notifications depend on NOAA's data feeds, our servers, Apple's and Google's notification services, your carrier, your device and its settings. Any of these can delay or drop a message. Do not rely on the Service for personal safety. Follow National Weather Service warnings and your own judgment. The lightning alert in particular is a courtesy, not a warning system.
You are responsible for the accuracy of the field boundaries and details you enter and for keeping your sign-in contact (phone or email) secure. You keep ownership of the information you put into the Service; you grant us the right to store and process it to provide the Service, as described in our Privacy Policy.
Do not use the Service to resell weather data, to scrape it, to interfere with it, or for any unlawful purpose. Do not enter fields you have no legitimate interest in monitoring.
During early access the Service is free. We will announce pricing before charging for anything, and paid plans will be governed by the terms shown at the time of purchase, including any app-store terms where a subscription is bought through Apple or Google.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, timely or error-free, or that any estimate will match what fell on the ground.
To the fullest extent permitted by law, FieldHail and its owners are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of crops, income, profits, data or goodwill, arising from your use of or inability to use the Service, even if advised of the possibility. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars, whichever is greater. Some jurisdictions do not allow certain limitations, in which case these apply to the extent permitted.
You may stop using the Service and ask us to delete your account at any time. We may suspend or end access for breach of these terms, for legal reasons, or if we discontinue the Service, in which case we will give reasonable notice where we can and let you export your hail record.
We may update these terms. The date above changes when we do, and material changes will be announced in the Service. Continued use after a change means you accept it.
These terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Minnesota.
FieldHail sends one kind of text message: a one-time six-digit sign-in code, sent only when you enter your own mobile number on the FieldHail sign-in form and request a code. You consent to receive it by submitting that form, and one message is sent per sign-in request. FieldHail does not send marketing text messages and does not operate a recurring text programme.
Message and data rates may apply. Reply HELP for help or STOP to opt out; replying STOP stops further text messages from FieldHail, and you can still sign in using your email address.
